Terms and Conditions

When you visit our website including our social media pages (Sites), these terms and conditions (Terms) form a binding agreement between us. If you do not agree with these Terms, you should not visit our Sites.


OUR SITES ARE NOT INTENDED FOR USE IN EMERGENCY SITUATIONS. IF YOU OR SOMEONE YOU ARE WITH IS SUFFERING AN ACUTE ILLNESS OR EMERGENCY, CALL 000 IMMEDIATELY AND ASK FOR AN AMBULANCE.


Our Services

1. Rhythm First Aid is a registered business ABN 63 634 197 292. We deliver training and assessment in partnership with Allens Training (RTO #90909).

2. Allens Training Pty Ltd is registered with the Australian Skills Quality Authority (ASQA) as a Registered Training Organisation (RTO 90909) to deliver vocational education and training services across all States and Territories of Australia.

3. All certificates are issued by Allens Training, on behalf of Rhythm First Aid.  Please refer to the student handbook located on the RTO website allenstraining.com.au for all details relating to rights and responsibilities including complaints and appeals.

4. We offer education, information and training (Information) to improve first aid outcomes for families and businesses.

5. Our Information is provided to increase your first aid knowledge and awareness to assist you to make decisions about how you respond in situations requiring first aid. We cannot guarantee any particular outcomes.

6. Any Information we offer is based on our experience and training on a no liability basis. This is because we offer general information about common scenarios in group settings without tailoring that information to any particular person or situation. In reality, you will find yourself in a wide variety of situations which are impacted by medical history, background circumstances and other matters that apply in the specific situations you may find yourself in. It is impossible for us to cover every scenario.

7. You must not use any Information to diagnose, treat, cure or prevent any disease or illness, or as a substitute for specific advice from a health professional.

8. It is your responsibility at all times to ensure a safe and appropriate response to your child. There is no one size fits all approach. You are responsible for exercising your own judgement in each individual circumstance.

9. There are occasions where your child may not respond to any of the methods we educate you about for various reasons including underlying medical issues. First aid information should be your first line of response only and implemented in conjunction with advice from your GP and where relevant, emergency services such as calling 000, arranging an ambulance or taking your child to an emergency room.

10. If in doubt, call 000 without hesitation.


Workshops

11. Our workshops (including our online masterclasses) are delivered on the basis of evidence based practice current at time of publication/delivery.

12. All workshops are provided on set topics and general information is provided which may not be suitable in a specific situation. If you require specific advice, we encourage you to see your GP or other chosen medical professional.

13. Fees for all workshops are non-refundable.

14. Masterclasses will be available for 12 months unless best practice changes in that time in which case we will withdraw the masterclass. The masterclass may be downloaded up to 4 times in that period.

15. Masterclasses are for individual, personal use only. You are not permitted to share your details or the download with any other person. You are not permitted to broadcast it or share it in a group setting. Please support our small business by making sure each person who benefits from out masterclass is paying us for our work as that allows us to keep offering these products to others.

16. Masterclasses must not be resold or delivered commercially. Please contact us for commercial and wholesale arrangements.


Fees

17. Prices for our products are subject to change without notice. The price that applies will be as confirmed in our invoice to you.

18. Payment is required upfront at the time that you book in with us. Your booking will not be confirmed until payment is received.

19. If for any reason we provide a service to you and you do not pay your invoice on time, unfortunately we will be required to pass on interest at 10% annually plus associated legal fees and/or debt collector fees.


Liability

20. We will not be liable for any delay or failure to perform our obligations if such delay is due to any circumstances beyond our reasonable control.

21. To the maximum extent permitted by law, our liability to you is limited to refunding any amounts paid by you in respect of the affected product or service, and if no amounts have been paid then $100.

22. Whilst we take reasonable care in producing our information, to the maximum extent permitted by law, we exclude any liability for any injury, illness, death, loss or damage caused by use of the information produced by us.

23. Rhythm First Aid, our directors, officers, employees, affiliates, agents, contractors, suppliers, service providers and licensors are not liable for any injury, loss, claim, or any direct, indirect, incidental, punitive, special, or consequential damages of any kind, including, without limitation lost profits, lost revenue, lost savings, loss of data, replacement costs, or any similar damages, whether based in contract, tort (including negligence), strict liability or otherwise, arising from any delays or failure in relation to delivery of the Items, your use of any of the Sites or any Information or items procured using the Sites, or for any other claim related in any way to your use of the Sites or any Information or item, including, but not limited to, any errors or omissions in any content, or any loss or damage of any kind incurred as a result of the use of the service or any content or product posted, transmitted, or otherwise made available via the Sites, even if we are made aware of their possibility.

24. First aid is an area subject to continuing research, clinical experience, reasonable differences in opinions among authorities, unique aspects of individual situations and the possibility of human error in preparing information.

25. We make no representation or warranty (express or implied) as to the currency, completeness, accuracy, reliability, suitability, fitness for purpose, non-infringement of third party rights and / or availability of any items, products, services, information or Sites, or that the items, products, services information or Sites will meet expectations or any person’s health or medical requirements.

26. You agree to indemnify and hold us harmless in respect of any third party claims arising as a result of your breach of these terms and conditions or your breach of any law or the rights of a third party.

27. We may assign our rights under these Terms and will provide you notice if we do so.

28. We may vary these Terms and they will apply to any booking after the varied Terms are published on our website. It is your responsibility to check for updates.

29. These Terms form the whole agreement between us and may not be varied orally.

30. The laws of Victoria, Australia apply to these Terms.

31. If any provision of these Terms is found to be unenforceable or unlawful, it is to be severed and the remaining provisions shall continue in force.


Cancellation Policy

32. We understand that sometimes things don’t go according to plan, so if you need to cancel, we get it. We ask that you let us know as soon as possible. We encourage you to rebook for another time wherever possible.

33. Any cancellations within 14 days of your booking will unfortunately result in forfeiting the entire fee. This is because we will have turned away other bookings at the time that your booking was for. We encourage you to contact us as early as possible to see if we can assist with rebooking or transferring your booking to another person.

34. We reserve the right to cancel any order or booking for any reason in our absolute discretion without any liability to you. Where we do so, we will refund any amounts paid by you for the affected booking or product(s).

35. We will not be liable for any delay or failure to perform our obligations if such delay is due to any circumstances beyond our reasonable control.

36. Rhythm First Aid does not offer refunds or exchanges for change of mind. Our full refund policy is here.


Products

37. We accept payment for products via the payment methods included on our website. Payment providers may have their own terms and conditions which apply in addition to ours. It is your responsibility to familiarise yourself with them.

38. After you make payment for your order, you will receive a transaction confirmation email which confirms receipt of your order. Your order is not binding on us until you receive this confirmation email.

39. If we need to cancel your order for any reason, we will refund all amounts paid by you.

40. If there is a problem with a product that you order, please notify us within 3 days of receiving it.

41. Please take care when entering your shipping details as we do not track your items and cannot amend those details after the order is placed in our system. If you do not have a safe place for an order to be left, please use a parcel locker.

42. Our first aid boxes contain all of the items we consider necessary for common situations. It may not contain all of the items you will need in every situation.

43. We reserve all intellectual property rights in our first aid boxes. We ask that you do not copy our business. If you like what you see, contact us about us supplying or partnering with you.

44. Rhythm First Aid carries a number first aid related products. Rhythm First Aid is a reseller of these items and does not take any responsibility for their manufacture or any defects. Rhythm First Aid’s liability is limited to refunding you the cost of an affected item. If there are any issues that need to be addressed directly with the original stockist, Rhythm First Aid will provide reasonable support and assistance in contacting the right person.

45. Descriptions of items are subject to change at any time without notice. We reserve the right to discontinue any item at any time.  Whilst we make every reasonable effort to display the Items as accurately as possible, the colors and images of the Items as they appear on our Sites may vary from how they appear in person. We cannot guarantee that your device will display any colors and images accurately.

46. We may replace products with like products in our discretion. 

47. Our liability to you for any incorrect listings is limited to amending or withdrawing that item once we are made aware of it. 

48. Some items may present potential hazards for young children and infants. You use the items at your own risk and must take responsibility for informing yourself and managing those risks for your family including storing them away from the reach of children and using them under appropriate supervision.

49. It is your responsibility to familiarise yourself with the items, to read all product labels and warnings and to ensure that they are suitable for your intended use including any medical conditions any person may have. We do not make any guarantees that the items are safe or recommended for any particular use.  


Website

50. Our Sites and every part of them is copyright. Reproduction of any part of our Sites is prohibited including images, posts, blogs, product descriptions, copy and wording. Permission must be gained before reproducing or reproducing anything on our Sites.

51. Our Sites are provided “as is” and “as available” without any guarantees as to its ongoing availability whether in part or in full.

52. We reserve the right at any time to modify or discontinue any product or service (or any part or content) without notice at any time.

53. We reserve the right to limit the sales of our products or services to any person, geographic region or jurisdiction. We reserve the right to limit the quantities of any products or services that we offer.

54. All information published on our Sites is for general information and educational purposes only. It does not take into account your specific situation and must not be relied upon by you as advice.

55. Whilst we use reasonable endeavours to keep the content on our Sites up to date, we do not guarantee that it is accurate, current or complete and accept no liability for errors.

56. We do not guarantee that our Sites will be free of errors, viruses, worms or other harmful codes. We exclude all liability to you for any loss resulting from your access or inability to access our Sites or its content.

57. Where we provide links to third party websites, we do so on a no liability basis, without endorsing or guaranteeing that content. Those sites will have their own terms and conditions which you should familiarise yourself with before using the site.
